Welcome to the Teertham Agent Partnership Program. These Terms and Conditions govern your participation as a registered agent on our platform. By registering as an agent, you agree to comply with these terms and all applicable laws and regulations.
1. Agent Eligibility and Registration
1.1 Eligibility Requirements
To become a Teertham agent, you must:
- Be at least 21 years of age
- Possess valid business registration or travel agency license
- Provide government-issued identification documents
- Have a valid GST registration number (if applicable)
- Maintain an active bank account for commission settlements
- Have no history of fraudulent activity or legal violations
1.2 Registration Process
Complete the agent registration form with accurate business and personal information, upload required documents (business license, ID proof, address proof, bank details), and wait for our verification team to review your application (typically 3-5 business days). Once approved, you will receive login credentials to access the agent dashboard.
1.3 Account Verification
We reserve the right to verify all information provided during registration. False or misleading information may result in immediate account suspension or termination without notice.
2. Agent Responsibilities
2.1 Professional Conduct
As a Teertham agent, you agree to:
- Provide accurate and honest information to customers
- Maintain professional communication standards
- Respond promptly to customer inquiries and booking requests
- Comply with all applicable travel and tourism regulations
- Protect customer privacy and personal information
- Not engage in fraudulent, deceptive, or misleading practices
2.2 Customer Service
You are responsible for providing excellent customer service to all clients you serve through our platform. This includes pre-booking consultation, accurate fare quotes, booking confirmations, and post-booking support. Customer complaints or negative feedback may affect your agent rating and commission eligibility.
2.3 Compliance
You must comply with all local, state, and national laws regarding travel bookings, taxation, and consumer protection. You are responsible for obtaining any necessary licenses or permits required to operate as a travel agent in your jurisdiction.
3. Commission Structure
3.1 Commission Rates
Agent commissions are calculated as a percentage of the booking value and vary by service type:
- Vehicle Bookings: 5-8% commission based on booking volume
- Hotel Bookings: 8-12% commission based on hotel partnership tier
- Spiritual Packages: 10-15% commission on package price
- Custom Packages: 12-18% commission based on package complexity
3.2 Commission Tiers
Your commission rate may increase based on performance metrics:
- Bronze Tier: 0-50 bookings per month - Base commission rates
- Silver Tier: 51-150 bookings per month - +1% bonus commission
- Gold Tier: 151-300 bookings per month - +2% bonus commission
- Platinum Tier: 301+ bookings per month - +3% bonus commission
3.3 Commission Calculation
Commissions are calculated on the net booking value after applicable discounts and before taxes. Cancellation charges and refund fees do not qualify for commission. Commissions are earned only on completed bookings where the service has been successfully delivered.
4. Payment Terms
4.1 Payment Schedule
Agent commissions are settled on a monthly basis. Payments are processed between the 5th and 10th of each month for the previous month's completed bookings. You must submit a valid tax invoice (if applicable) to receive payment.
4.2 Minimum Payout Threshold
The minimum payout threshold is ₹1,000. If your earnings are below this threshold, the amount will be carried forward to the next payment cycle until the threshold is met.
4.3 Payment Method
Payments are made via direct bank transfer (NEFT/RTGS) to the bank account registered during sign-up. Ensure your bank details are accurate and up-to-date. We are not responsible for payment delays or errors caused by incorrect banking information.
4.4 Tax Deductions
Tax Deducted at Source (TDS) will be deducted as per applicable Indian tax laws. You will receive a TDS certificate for tax filing purposes. It is your responsibility to comply with all tax obligations in your jurisdiction.
5. Booking and Cancellation Rules
5.1 Booking Authority
As an authorized agent, you can make bookings on behalf of customers through the agent dashboard. All bookings are subject to availability and confirmation from service providers. You must provide accurate customer information for all bookings.
5.2 Cancellation Handling
If a customer cancels a booking, standard cancellation policies apply. Your commission will be adjusted based on the final refund amount. If a full refund is issued, no commission will be paid. Partial cancellations result in proportional commission adjustments.
5.3 Fraudulent Bookings
Any bookings identified as fraudulent or made with malicious intent will result in immediate commission forfeiture and potential legal action. You are responsible for verifying customer identity and payment authenticity.
6. Prohibited Activities
Agents are strictly prohibited from:
- Making false or misleading claims about services or pricing
- Engaging in price manipulation or unauthorized discounting
- Sharing login credentials with unauthorized individuals
- Attempting to circumvent the platform to conduct direct bookings
- Soliciting customers for services outside the Teertham platform
- Using customer data for unauthorized marketing or commercial purposes
- Creating multiple accounts to manipulate commission structures
- Engaging in negative marketing against Teertham or competitors
7. Intellectual Property
7.1 Platform Content
All content on the Teertham platform, including logos, trademarks, service descriptions, images, and software, is the intellectual property of Teertham or its licensors. You may not reproduce, modify, distribute, or create derivative works without prior written permission.
7.2 Marketing Materials
We provide approved marketing materials (brochures, images, social media templates) that you may use to promote services. You must use these materials as provided without alteration. Custom marketing materials using Teertham branding require prior approval.
8. Confidentiality
As an agent, you may have access to confidential information including pricing structures, commission details, customer data, and business strategies. You agree to maintain strict confidentiality and not disclose any such information to third parties during and after your partnership with Teertham.
9. Termination
9.1 Voluntary Termination
You may terminate your agent account at any time by providing 30 days written notice. Upon termination, you will receive payment for all earned commissions up to the termination date, subject to the minimum payout threshold.
9.2 Termination by Teertham
We reserve the right to suspend or terminate your agent account immediately if you:
- Violate any terms and conditions outlined in this agreement
- Engage in fraudulent, illegal, or unethical activities
- Receive multiple customer complaints or negative reviews
- Fail to meet minimum performance standards
- Provide false information during registration or operations
9.3 Post-Termination
Upon termination, you must immediately cease using the Teertham platform and any proprietary materials. Confidentiality obligations continue after termination. Outstanding commissions will be settled as per standard payment terms.
10. Liability and Indemnification
10.1 Limitation of Liability
Teertham is not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform or participation in the agent program. Our total liability is limited to the amount of commissions payable to you in the three months preceding the claim.
10.2 Agent Indemnification
You agree to indemnify and hold harmless Teertham from any claims, damages, losses, or expenses arising from your breach of these terms, misrepresentation to customers, or violation of third-party rights.
11. Dispute Resolution
11.1 Governing Law
These Agent Terms and Conditions are governed by the laws of India. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra.
11.2 Arbitration
In case of disputes, both parties agree to first attempt resolution through good faith negotiation. If unresolved, disputes may be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.
12. Changes to Terms
We reserve the right to modify these Agent Terms and Conditions at any time. Material changes will be communicated via email at least 15 days before taking effect. Continued use of the platform after changes indicates your acceptance of the modified terms.
