Welcome to the Teertham Hotel Partnership Program. These Terms and Conditions govern your participation as a hotel partner on our platform. By registering your property, you agree to comply with these terms and maintain the quality standards expected by our customers.
1. Partner Eligibility and Registration
1.1 Eligibility Requirements
To join as a hotel partner, your property must:
- Be a legally registered business with valid trade license
- Possess necessary permits and compliance certifications (fire safety, health, tourism)
- Have a minimum of 5 guest rooms or accommodation units
- Maintain adequate liability insurance coverage
- Comply with local tourism and hospitality regulations
- Have working communication channels (phone, email) for booking confirmations
1.2 Registration Process
Complete the hotel partner registration form with accurate property details, upload required documents (business registration, tax certificates, property photos, amenity lists), provide bank account details for payment settlement, and wait for our verification team to review and approve your listing (typically 5-7 business days).
1.3 Property Verification
Our team may conduct physical inspections to verify the property condition, amenities, and compliance with safety standards. False representation of property features or misleading information may result in immediate listing suspension.
2. Listing Management
2.1 Property Information
You are responsible for maintaining accurate and up-to-date property information including:
- Room types, capacities, and configurations
- Amenities and facilities (WiFi, parking, dining, etc.)
- High-quality property and room photographs
- Accurate pricing for all seasons and room categories
- Check-in/check-out times and policies
- Cancellation and modification policies
2.2 Room Inventory and Availability
You must maintain real-time room availability on the platform to prevent overbooking. Update your calendar promptly to reflect accurate availability. Failure to honor confirmed bookings due to unavailability may result in penalties, commission forfeiture, and listing suspension.
2.3 Pricing and Rate Parity
You agree to offer competitive pricing on our platform. Rate parity ensures that prices on Teertham are equal to or better than those offered on your own website or other booking platforms. Promotional rates and special offers must also be reflected on our platform.
3. Commission Structure
3.1 Standard Commission Rates
Teertham charges a commission on each booking based on the property tier:
- Basic Tier: 15-18% commission on room revenue
- Premium Tier: 12-15% commission (high-rated properties with excellent reviews)
- Exclusive Tier: 10-12% commission (top-performing partners with 100+ bookings/month)
3.2 Commission Calculation
Commission is calculated on the net room revenue (excluding taxes). Additional services like meals, spa treatments, or other ancillary charges booked separately are not subject to platform commission. However, package deals that include rooms and services are subject to commission on the entire package value.
3.3 Promotional Discounts
When participating in platform-wide promotional campaigns, you agree to offer discounts as specified. Commission rates during promotions may be adjusted, and Teertham may contribute to the discount to incentivize bookings.
4. Payment Terms
4.1 Payment Settlement
Payments are settled on a bi-weekly basis. After a guest checks out, funds are processed and transferred to your registered bank account within 7-10 business days, minus the applicable commission and any deductions for cancellations or disputes.
4.2 Payment Method
Payments are made via direct bank transfer (NEFT/RTGS). Ensure your bank details are accurate and updated in the partner dashboard. We are not liable for payment delays or errors caused by incorrect banking information.
4.3 Tax Compliance
You are responsible for all applicable taxes including GST, income tax, and local levies. We will provide necessary transaction reports for your tax filing. TDS will be deducted as per Indian tax regulations, and you will receive a TDS certificate.
4.4 Withholding for Disputes
In case of customer disputes, refund requests, or complaints, we reserve the right to withhold payment until the issue is resolved. If the dispute is resolved in the customer's favor, the refund amount will be deducted from your settlement.
5. Booking Management
5.1 Booking Confirmation
You will receive booking notifications via email, SMS, and the partner dashboard. You must confirm or decline bookings within 2 hours. Auto-decline settings can be configured for unavailable dates. Failure to respond may result in automatic booking confirmation.
5.2 Honoring Reservations
All confirmed bookings must be honored. Denying a guest with a valid booking confirmation is a serious violation and may result in penalties, negative reviews, and potential delisting. If an emergency prevents you from accommodating a guest, you must immediately inform Teertham and assist in finding alternative accommodation.
5.3 Overbooking Policy
If you are unable to accommodate a guest due to overbooking, you must arrange alternative accommodation of equal or higher standard at your own expense. Repeated overbooking will result in commission penalties and listing demotion.
6. Guest Experience and Quality Standards
6.1 Service Quality
You agree to maintain high service standards including:
- Clean, well-maintained rooms and facilities
- Courteous and professional staff behavior
- Prompt response to guest requests and complaints
- Adherence to advertised amenities and services
- Compliance with health, safety, and hygiene standards
6.2 Guest Reviews and Ratings
Guests can leave reviews and ratings after their stay. Reviews are published on your property listing and influence your visibility and ranking. You can respond to reviews but cannot request removal of genuine reviews. Repeated negative reviews may result in listing demotion or suspension pending improvement.
6.3 Mystery Guest Audits
Teertham reserves the right to conduct mystery guest audits to verify property quality and service standards. Audit results may affect your listing status, tier, and commission rates.
7. Cancellation and Refund Policies
7.1 Defining Cancellation Policies
You may set your own cancellation policies, which must be clearly communicated during booking:
- Flexible: Free cancellation up to 24-48 hours before check-in
- Moderate: Partial refund if cancelled 3-7 days before check-in
- Strict: Non-refundable or minimal refund upon cancellation
7.2 Processing Cancellations
When a guest cancels a booking, you must process the cancellation according to your stated policy. Refunds must be issued within 7-10 business days. Failure to honor cancellation policies may result in complaints and listing penalties.
7.3 Force Majeure
In cases of natural disasters, pandemics, government restrictions, or other force majeure events, standard cancellation policies may be waived. Teertham will work with you to offer flexible rebooking or refunds to affected guests.
8. Prohibited Activities
Hotel partners are strictly prohibited from:
- Soliciting guests to book directly outside the platform to avoid commission
- Manipulating reviews or ratings through incentives or fake accounts
- Providing misleading information about property features or location
- Discriminating against guests based on race, religion, gender, or nationality
- Charging guests additional fees not disclosed during booking
- Using guest data for unauthorized marketing or selling to third parties
- Listing duplicate properties under multiple accounts
9. Liability and Insurance
9.1 Hotel Liability
You are solely responsible for the safety and well-being of guests during their stay. Teertham is not liable for injuries, accidents, theft, or losses that occur on your property. You must maintain adequate insurance coverage including general liability, property damage, and guest accident insurance.
9.2 Indemnification
You agree to indemnify and hold harmless Teertham from any claims, damages, losses, or legal expenses arising from guest injuries, property damage, breach of contract, or violation of laws during a guest's stay at your property.
10. Intellectual Property
10.1 Property Content
By uploading photos, descriptions, and other content to the platform, you grant Teertham a non-exclusive, worldwide license to use, display, and promote this content for marketing purposes. You represent that you own or have the right to use all uploaded content.
10.2 Platform Branding
You may use Teertham branding materials (partner badge, promotional graphics) as provided to promote your listing. Unauthorized alteration or misuse of Teertham trademarks is prohibited.
11. Termination
11.1 Voluntary Termination
You may terminate your partnership by providing 30 days written notice. All pending bookings must be honored, and final payment settlement will be processed after all outstanding obligations are fulfilled.
11.2 Termination by Teertham
We reserve the right to suspend or terminate your listing immediately if you:
- Violate any terms outlined in this agreement
- Receive consistent negative reviews or guest complaints
- Fail to honor confirmed bookings or maintain quality standards
- Engage in fraudulent or unethical practices
- Do not respond to bookings or customer inquiries
12. Dispute Resolution
12.1 Governing Law
These Hotel Partner Terms are governed by the laws of India. Disputes arising from this agreement shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra.
12.2 Arbitration
In case of disputes, both parties agree to attempt resolution through good faith negotiation. Unresolved disputes may be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.
13. Changes to Terms
We may modify these Hotel Partner Terms at any time. Material changes will be communicated at least 30 days before taking effect. Continued use of the platform after changes indicates acceptance of the modified terms.
